Elderly Rights and Turkish Regulations

The legal status of a care home resident in Turkey is protected by the Turkish Civil Code (TMK) and the Law on the Human Rights and Equality Institution (TİHEK). These laws ensure that institutionalisation does not equate to loss of civil liberties.

The Guardianship (Vesayet) System

For many seniors, the transition to institutional care involves a legal process known as "Vasilik" (Guardianship). This is a judicial procedure — only a Civil Court of Peace (Sulh Hukuk Mahkemesi) can appoint a guardian, not a notary.

TMK Article 412: Residency Change Protection

A critical protection under TMK Article 412: a guardian cannot change a resident's official place of residency (e.g., moving them to a different facility in a different city) without explicit permission from the relevant court. This prevents families from moving an elderly relative between facilities across cities without judicial oversight.

Resident Rights: TİHEK Inspection Findings

  • Residents have a fundamental right to be protected from torture, cruel or inhuman treatment
  • Right to bring personal belongings — to maintain a home-like environment
  • Right to meet face-to-face with administrators to voice grievances
  • Failure to address reported neglect or abuse can result in immediate licence cancellation
  • Visiting rights — private living quarters may only be entered with the resident's explicit permission
